Foreign Investment Compliance Guidelines

The Foreign Investment Law of the People's Republic of China ("Foreign Investment Law") came into effect on January 1, 2020, and three previous laws on foreign investment were abolished simultaneously. In order to facilitate the smooth transition from the past foreign investment supervision system to the Foreign Investment Law era, we launched the Chinese version of the Foreign Investment Compliance Guidelines (“Guidelines”) in this January, which covers procedural matters regarding the  incorporation and changes of foreign-invested enterprises, practical guidelines for foreign investors on strategic investment and cross-border capital supervision and other issues surrounding foreign investments in China. The Guideline also contains templates of documents required to be submitted for foreign-invested enterprises to adjust to the same organizational form as domestic-invested enterprises.

 

The Chinese version of the Guidelines has received enormous positive comments from foreign invested companies since its launch this January. In order to make it more accessible to foreign investors so that necessary adjustments can be made timely within the five-year transition period as stipulated in the Foreign Investment Law, Global Law Office and LexisNexis jointly launched the English version of the Guidelines.
