Deming Zhao Speaks at Finland Arbitration Institute (FAI) 115th Anniversary Conference

2026年8月21日，环球律师事务所赵德铭博士应邀出席赫尔辛基仲裁机构（FAI）115周年庆大会，并作为“当合同撞上地缘政治”圆桌论坛主题演讲嘉宾，发表专业观点和评论。

On August 21, 2026, Dr. Deming Zhao of Global Law Office attended the Finland Arbitration Institute (FAI) 115th Anniversary Conference in Helsinki as an invited speaker. He spoke on the panel "When Contracts Collide with Geopolitics".

赵德铭首先阐述了中国法作为争议准据法时外国制裁与出口管制法律并没有法律效力的地位，其次介绍了中国反制（阻断）外国长臂管辖以及干涉内政型的对华歧视性、限制性措施的现状，说明了中国政府反制仍谨守“有理、有利、有节”的范畴，反映了有限但精准的反制方针，而并未一味为反制而反制，避免了跨国投资和经营在中美之间总体落入两难的境地。

Dr. Zhao first addressed the legal effect of foreign sanctions and export control laws under Chinese law. Such foreign laws have no force of law when Chinese law governs the contractual dispute. He then outlined China's countermeasures, including blocking measures taken against extraterritorial application of foreign laws and discriminatory or restrictive measures interfering in internal affairs of China. He described China's countermeasures as justified, effective and restrained, reflecting an approach limited in scope but precise in application, rather than retaliation for its own sake. This approach has helped reduce the risk of multinational businesses being caught between China and the United States.

赵德铭最后分析了公开报导的中国海事法院适用《反外国制裁法》的两个案例，总结出在华涉及外国制裁和出口管制案件司法化而非仲裁化的新型趋势，并且以新近霍尔木兹海峡船舶碰撞案在华迅速调解解决为例，亦说明在复杂地缘政治环境下中国或者中国法作为处理国际争议的管辖地或者适用法的中立性与可预先性。赵德铭的发言受到了与会者的高度赞赏。

Dr. Zhao analyzed two publicly reported cases in which Chinese maritime courts applied the Anti-Foreign Sanctions Law. He noted an emerging trend in China toward resolving disputes involving foreign sanctions and export controls through litigation rather than arbitration. He also referred to the recent vessel collision case in the Strait of Hormuz, which was swiftly settled through mediation in China. The case illustrated the neutrality and predictability of China as a forum and Chinese law as the applicable law for resolving international disputes in a complex geopolitical environment. His remarks were well received by the participants.

本次赫尔辛基仲裁机构115周年庆祝大会线下与线上参加的人数近280人，分别来自40个国家和地区。本次大会除了资深仲裁员Gary Born先生的主旨演讲外，先后进行了三个圆桌论坛，其中另外两个圆桌论坛的主题分别是“当国家方走进仲裁庭”以及“当裁决书遇到国家权力”。这些主题的讨论和发酵将对国际仲裁界产生较大的影响。

Around 280 arbitration professionals from some 40 jurisdictions attended the Finland Arbitration Institute's 115th anniversary conference in Helsinki and online. It opened with the Helsinki Lecture 2026 by Gary Born, followed by three panels: "When Contracts Collide with Geopolitics", "When the State Enters the Hearing Room", and "When Awards Meet Power". The discussions as amplified are expected to have a significant impact on the international arbitration community.

赵德铭目前为上海仲裁委员会、上海国际经济贸易仲裁委员会以及厦门仲裁委员会仲裁员，并拥有多年处理国际贸易与海事纠纷以及在伦敦海事仲裁和新加坡仲裁程序中担任中国法律专家证人的经验。2024-2026年，Benchmark Litigation中国争议解决律师榜单将赵德铭推荐为“政府与监管以及海事海商领域诉讼之星”。

Dr. Zhao currently serves as an arbitrator with the Shanghai Arbitration Commission, the Shanghai International Economic and Trade Arbitration Commission and the Xiamen Arbitration Commission as well. He has extensive experience as counsel in international trade and maritime disputes. He has also served as Chinese law expert witness in London maritime arbitration and Singapore arbitration proceedings. Benchmark Litigation ranked Dr. Zhao as the "Litigation Star – Government & Regulatory and Shipping Law" in China dispute resolution rankings for 2024 through 2026.
