赵德铭应邀为厦门国际法高等研究院暑期研修班开幕授课

Dr. Deming Zhao Lectured at the Opening Ceremony at the Summer Program of Xiamen Academy of International Law

应厦门国际法高等研究院以及厦门仲裁委员会的邀请，陈安国际法学讲座教授、环球赵德铭博士于2026年6月22日出席厦门国际法高等研究院2026年暑期研修班开幕式，并作英文开幕讲座。联合国国际法委员会委员Penelope RIDINGS博士以及联合国国际法委员会委员、伦敦大学学院教授Martins PAPARINSKIS等亦在开幕式上发言。

On June 22, 2026, as invited by Xiamen Academy of International Law and Xiamen Arbitration Commission, Dr. Deming Zhao, partner of Global Law Office and chair professor of Chen An International Law, attended the opening ceremony of the 2026 Summer Program of Xiamen Academy of International Law, and delivered his opening lecture in English. Dr. Penelope RIDINGS, Member of the United Nations International Law Commission, and Professor Martins PAPARINSKIS, Member of the United Nations International Law Commission and professor of law at University College London, also made a speech at the opening ceremony.

赵德铭以《美国经济制裁与中国反制对于诉讼和仲裁实践的影响》为题，从伦敦国际仲裁院出口管制与经济制裁等相关仲裁规则出发，分析其中的含义及其背后的经济制裁对于仲裁机构以及仲裁员的风险，并以英国仲裁和诉讼案例以及中国的反制诉讼案例，总结在经济制裁背景下仲裁机构与法院不同的角色、完善仲裁法中法院对于仲裁的协助力度、反制诉讼的实务问题，以及当事人事先就管辖权、准据法以及经济制裁等事项进行事先约定的重要性，通常可以避免仲裁机构与仲裁员的仲裁难度与风险。

The lecture of Dr. Zhao focused on "The Impact of US Economic Sanctions and China Countermeasures on Litigation and Arbitration Practice". With the provisions of the LCIA Arbitration Rules concerning export controls and economic sanctions, he analyzed their implications and their underlying US economic sanctions to the risks of which the arbitral institution and arbitrators may be exposed. With the study of arbitration and litigation cases in the United Kingdom as well as counter-sanctions litigation case in China, he summarized the parts the arbitral institutions and courts may play differently in the context of economic sanctions, suggested more judicial assistance to arbitration to be prescribed under the arbitration law of China. He also analyzed the practical issues in counter-sanctions litigation, and the significance of the commercial parties to make contractual provisions addressing issues of jurisdiction, governing law and economic sanctions, the latter of which normally can mitigate the difficulty and risks for arbitral institutions and arbitrators.

来自20多个国家和地区以及中国大陆各主要高校法学院的学生、法律工作者和政府官员等200余人，参加了本次开幕式。

More than 200 participants, including students, legal practitioners and government officials from over 20 countries and regions and from major law schools across mainland of China, attended the opening ceremony.

厦门国际法高等研究院（以下简称为“研究院”）于2005年4月在荷兰海牙成立，是亚太地区最早创立的国际法学高等专门研究机构。研究院于2006-2025年成功举办了18届暑期研修班，应邀前来研修班讲学的国际法专家合计达100多人（含国际法院大法官10人），参加研修班的海内外学员合计达1800多人。

The Xiamen Academy of International Law (the "Academy") was established in Hague, the Netherlands, in April 2005, and is the earliest specialised advanced institutes of international law in the Asia-Pacific region. From 2006 to 2025, the Academy successfully held 18 summer programmes, inviting more than 100 international law experts, including ten judges of the International Court of Justice, to teach at the programmes. More than 1,800 participants from China and overseas have attended the programmes.

厦门仲裁委员会成立于1996年1月。在中国仲裁机构公信力评估中，连续两届获评“涉外服务十佳机构”；获司法部“全国公共法律服务工作先进集体”表彰，入选司法部中国特色的国际一流仲裁机构培育工程首批培育名单。

The Xiamen Arbitration Commission was established in January 1996. In the credibility evaluations of Chinese arbitration institutions, it has twice been rated among the "Top Ten Institutions for Foreign-Related Services". It has been commended by the Ministry of Justice as a "National Advanced Collective in Public Legal Services"; and it has been included in the first batch of institutions under the Ministry of Justice’s cultivation project for international first-class arbitration institutions with Chinese characteristics.
